Terms of Use
Welcome to the ClimbPath application (hereinafter referred to as the “Application”). By creating an account or using the Application in any way, you confirm that you have read these Terms of Use and the Privacy Policy and agree to be bound by them. If you do not agree with these terms, please do not use the Application, whether in its mobile or web version.
1. Copyright and Intellectual Property
All materials within the ClimbPath Application, including texts, images, map data, design elements, and data, are protected by copyright and intellectual property laws. Their use is permitted solely for personal, non-commercial purposes. Any further distribution, modification, data mining, automated extraction of content, or other use without prior written consent from the operator is strictly prohibited.
1.1 Via Ferrata Data
All information about via ferratas, including route descriptions, terrain data, difficulty ratings, safety information, and related data, forms part of the Application content and may be protected by copyright or database rights. Systematic copying, automated extraction (scraping), or use of this data outside the Application without prior written consent from the operator is prohibited. Users acknowledge that content they add to the Application (such as new ferratas, edits, comments, or additional information) may be further used, modified, and published by the operator within the Application and its services in accordance with the [License Agreement](/license).
1.2 Reviews and User Content
Reviews, ratings, and comments regarding via ferratas are user-generated content. Their authors are solely responsible for their content. The operator is not responsible for their accuracy, completeness, or current validity. Users are responsible for ensuring that their content does not violate third-party rights and does not contain illegal or misleading material. By uploading content, users grant the operator a license to display, format, modify (e.g., shortening, moderation, translation), and use such content within the Application and related services according to the terms stated on the [License Agreement](/license) page.
1.3 User-Uploaded Photos
Photos and other media uploaded by users must be created by the user or the user must have appropriate rights to use them. Users are fully responsible for the content they upload. By uploading content, users grant the operator a non-exclusive, worldwide, royalty-free license to store, display, technically process (such as resizing or compression), and publish the content within the Application and its features. Content may also be used in connection with operating and promoting the Application, including sharing through external services (such as search engines or social networks), always within the scope defined on the [License Agreement](/license) page. Users may request removal of their content at any time unless such removal conflicts with legal or operational obligations.
1.4 Internal API and Technical Interfaces
Any unauthorized use, access attempts, attempts to gain unauthorized access, security bypasses, misuse of internal APIs, technical interfaces, or system functions of the Application are strictly prohibited. Automated access without explicit permission from the operator is not allowed. The operator reserves the right to monitor and record suspicious activity. Any violation of this provision may be reported to relevant authorities and may be subject to civil, administrative, or criminal proceedings. The operator may seek compensation for damages, unjust enrichment, and other remedies available under applicable laws.
1.5 3D Models and 3D Topographic Data
All 3D models, 3D map data, 3D topographic data, and related visualizations are protected by copyright. Downloading, extracting, reverse engineering, commercial use, or any other unauthorized use is prohibited. Any attempt to obtain this data outside the official Application interfaces is strictly forbidden.
2. User Account and Registration
- Registration is required to use certain Application features, such as saving routes and storing activity history on our servers.
- You agree to provide truthful and accurate information during registration.
- You are fully responsible for maintaining the security of your account and protecting your password from misuse.
- The operator is not responsible for unauthorized use of your account by third parties.
3. User Location and GPS Services
The ClimbPath Application requires access to location services for its core functionality (tracking and discovering nearby via ferratas). Without this permission, key features of the Application cannot be used. The operator is not responsible for inaccuracies in GPS data, signal loss, or technical limitations of the location services provided by your device.
4. Code of Conduct (Prohibited Activities)
When using the Application, the following activities are strictly prohibited:
- Uploading content that is illegal, offensive, vulgar, hateful, or infringes copyright or other rights.
- Intentionally sharing dangerous or false information about mountain routes and via ferratas that could endanger the health or lives of other users.
- Sharing fake routes, manipulating GPS data, or otherwise abusing tracking features.
- Flooding the Application with spam or fake reviews.
- Attempting to hack or compromise the security of servers.
5. Route Suggestions and User Content
- Users may suggest new via ferratas and add reviews through the Application.
- This content serves as a suggestion for review, and the operator reserves the right to edit, reject, or remove it without providing a reason.
- By uploading photos (from routes), you confirm that you are the author or have permission to use them.
- You are fully responsible for the legality of your content. Since these materials are publicly visible to other users, the operator is not responsible for misuse or copying by third parties.
6. Disclaimer
The ClimbPath Application provides information about via ferratas and natural terrain.
- Use at Your Own Risk: All sports activities and movement in mountain terrain are performed entirely at your own risk.
- Informational Purpose: Routes displayed in the Application are provided for inspiration only. We do not guarantee 100% accuracy of GPS coordinates, difficulty ratings, or current terrain conditions (such as bad weather, rockfalls, or damaged fixed cables).
- Safety: The Application does not replace common sense, certified and appropriate equipment (harness, via ferrata lanyard, helmet), or adequate mountain experience.
- Limitation of Liability: We accept no legal or financial responsibility for injuries, health damage, death, or property damage resulting from activities inspired by or guided through our Application. We are also not responsible for violations of access restrictions, unauthorized entry onto private property, or damage to protected nature caused by users.
- Data Security: The Application uses reasonable technical and organizational measures to protect data, including encrypted data transmission (such as HTTPS/TLS) and other security mechanisms. However, absolute data security cannot be guaranteed, and the risk of unauthorized access, third-party attacks, or technical failures cannot be completely eliminated. Users acknowledge that no online system is completely immune to security risks.
7. Right to Delete an Account
We reserve the right to suspend, block, or permanently delete your account and all associated data (including tracks and photos), without prior notice, if you violate these rules or threaten the operation of the Application or its community.
8. Changes to These Terms
We reserve the right to modify these Terms of Use at any time without prior personal notice. Changes become effective from the date they are published in the Application. By continuing to use the Application after changes are made, you agree to the updated terms.
